Welcome to Tapiyo. These Terms & Conditions (“Terms”) govern your access to and use of the Tapiyo website, digital business card services, NFC products, QR codes, profiles, applications, and related services (collectively, the “Service”).

By creating an account, purchasing a Tapiyo product, or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. About Tapiyo

Tapiyo provides digital networking and business identity solutions, including digital business cards, NFC-enabled products, QR codes, online profiles, contact-sharing tools, and related services.

The Service may be updated, modified, expanded, or discontinued from time to time.

2. Eligibility

You must provide accurate information when creating an account or using the Service.

By using Tapiyo, you confirm that:

You are legally capable of entering into a binding agreement.
The information you provide is accurate and up to date.
You will use the Service in accordance with applicable laws and regulations.
You will not use Tapiyo for fraudulent, unlawful, abusive, or harmful activities.

If you are using Tapiyo on behalf of a company or organization, you confirm that you have the authority to accept these Terms on its behalf.

3. Account Registration

Certain Tapiyo features may require you to create an account.

You are responsible for:

Keeping your login credentials confidential.
Maintaining accurate account information.
All activity carried out through your account.
Immediately notifying Tapiyo if you believe your account has been accessed without authorization.

Tapiyo is not responsible for losses resulting from your failure to protect your account credentials.

4. Digital Profiles

Tapiyo allows users to create digital profiles containing information such as:

Name and job title
Company information
Phone numbers
Email addresses
Websites
Social media links
WhatsApp links
Business locations
Images and logos
Other information supported by the Service

You are responsible for the information you publish on your profile.

You must not publish content that is unlawful, fraudulent, misleading, defamatory, abusive, threatening, sexually explicit, discriminatory, or otherwise inappropriate.

Tapiyo reserves the right to remove or restrict content that violates these Terms or applicable law.

5. NFC Cards and Products

If you purchase an NFC card or other physical Tapiyo product:

Product appearance may vary slightly from images shown on the website.
Delivery times may vary depending on location, shipping provider, and other circumstances.
You are responsible for providing an accurate delivery address.
Tapiyo is not responsible for delays caused by incorrect delivery information provided by the customer.
NFC functionality depends on the compatibility and configuration of the user's device.
The physical NFC product does not itself guarantee internet connectivity or access to the Tapiyo Service.

6. QR Codes and Profile Links

Tapiyo may provide QR codes and unique profile links for sharing your digital profile.

You agree not to use QR codes or profile links to:

Redirect users to fraudulent websites.
Distribute malware or harmful software.
Promote illegal activities.
Misrepresent another individual or organization.
Conduct phishing, scams, or other deceptive activities.

Tapiyo may disable links or QR codes associated with accounts that violate these Terms.

7. Payments and Subscriptions

Certain Tapiyo features may require payment.

Where applicable:

Prices are displayed on the Tapiyo website or during checkout.
Payment must be completed using an available payment method.
Subscription plans may automatically renew unless cancelled before the applicable renewal date.
Taxes, including applicable VAT, may apply.
Tapiyo may change pricing for future subscription periods by providing appropriate notice where required.

If a payment fails, Tapiyo may restrict or suspend access to paid features until payment is successfully completed.

8. Cancellation

You may cancel your subscription according to the cancellation options available through your Tapiyo account or by contacting support.

Cancellation of a subscription does not necessarily result in an automatic refund for a previously completed billing period unless required by applicable law or expressly stated in Tapiyo's refund policy.

9. Refunds

Refund eligibility depends on the applicable product, subscription, purchase terms, and circumstances.

Physical NFC cards and customized products may have different refund or replacement conditions.

Where a product arrives damaged or defective, you should contact Tapiyo support within a reasonable period and provide relevant details or photographs when requested.

Nothing in this section limits any mandatory consumer rights available under applicable law.

10. Intellectual Property

All Tapiyo software, website content, designs, logos, trademarks, graphics, text, interfaces, and other materials provided by Tapiyo are owned by or licensed to Tapiyo and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit Tapiyo's intellectual property without prior written permission.

You retain ownership of content that you submit to Tapiyo, subject to the rights necessary for Tapiyo to operate and provide the Service.

11. User Content

You are responsible for all content you upload, publish, or share through Tapiyo.

By submitting content, you grant Tapiyo a limited, non-exclusive right to host, process, display, and transmit that content as necessary to provide the Service.

You represent that you have the necessary rights and permissions to use and publish the content you provide.

12. Prohibited Activities

You must not use Tapiyo to:

Violate applicable laws or regulations.
Impersonate another person or organization.
Commit fraud or facilitate scams.
Send spam or unsolicited communications.
Distribute malware or malicious code.
Attempt unauthorized access to Tapiyo systems.
Interfere with the operation or security of the Service.
Collect information from other users through unauthorized methods.
Use the Service to promote illegal goods or services.
Abuse, harass, threaten, or harm others.
Circumvent security or access restrictions.

13. Third-Party Services

Tapiyo profiles may contain links to third-party websites, applications, social media platforms, payment providers, mapping services, or other external services.

Tapiyo does not control these third-party services and is not responsible for their content, availability, privacy practices, security, or terms.

Your use of third-party services is subject to the terms and policies of those providers.

14. Service Availability

Tapiyo aims to provide reliable and continuous service but does not guarantee that the Service will always be available, uninterrupted, or error-free.

The Service may occasionally be unavailable due to:

Maintenance
Updates
Hosting or infrastructure issues
Network failures
Security incidents
Third-party service failures
Events beyond Tapiyo's reasonable control

Tapiyo may temporarily suspend access when necessary to maintain or protect the Service.

15. Data and Privacy

Your use of Tapiyo is also subject to our Privacy Policy, which explains how personal information is collected, used, stored, and processed.

You are responsible for ensuring that information you publish through your profile is appropriate for public or intended sharing.

16. Account Suspension or Termination

Tapiyo may suspend, restrict, or terminate an account if:

You violate these Terms.
Your activity creates a security or legal risk.
Your account is involved in fraudulent or abusive activity.
Required payments remain unpaid.
Suspension is required by applicable law or a lawful authority.

Where reasonably possible, Tapiyo may provide notice before termination unless immediate action is necessary.

17. Disclaimer

The Service is provided on an “as available” and “as is” basis to the extent permitted by applicable law.

Tapiyo does not guarantee that:

The Service will always meet your specific requirements.
The Service will be uninterrupted or error-free.
Every device will support every NFC feature.
Third-party services linked through your profile will remain available.
Information provided by other users will always be accurate.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Tapiyo and its owners, employees, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Tapiyo and its affiliates, employees, officers, and service providers harmless from claims, losses, damages, liabilities, and expenses arising from:

Your violation of these Terms.
Your misuse of the Service.
Content you publish through Tapiyo.
Your violation of another person's rights.
Your violation of applicable laws or regulations.

20. Changes to These Terms

Tapiyo may update these Terms from time to time.

Updated Terms will be published on this page with a revised “Last Updated” date.

Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the legal entity operating Tapiyo and the jurisdiction specified in the applicable order or service agreement.

Any disputes shall be subject to the jurisdiction of the competent courts of that jurisdiction, unless applicable law provides otherwise.
